Introduction

​

This Comprehensive Resort Policy and Procedures Statement or Terms and Conditions Statement ("Policy") is designed to establish a framework of expectations, rules, and guidelines to ensure the smooth operation of the resort, the safety and enjoyment of all guests, and the protection of the property and its owners from potential liabilities. This Policy is extensive in nature, crafted with the intention to cover all conceivable scenarios that may arise during the operation of the resort. By engaging with our services and agreeing to stay at our resort, all guests, herein referred to as "the Party", "Guest(s)", or "Patron(s)", are automatically bound to the terms and conditions laid out in this Policy, henceforth agreeing to adhere strictly to its stipulations.

General Liability Disclaimer

The resort, including its owners, operators, employees, and agents (hereinafter collectively referred to as "The Resort"), shall not be liable for any injury, loss, damage, accident, delay, inconvenience, or irregularity attributable to any person or entity, which may be sustained by or to any resort guest, visitor, pet, or their property, except to the extent that such damage is the direct result of willful misconduct or gross negligence by The Resort.

Assumption of Risk

​

Guests expressly acknowledge and accept that their stay at and use of The Resort’s facilities, including but not limited to the cabins, pool area, recreation rooms, and outdoor spaces, carry inherent risks that may result in personal injury, property damage, or loss. By agreeing to these terms, guests voluntarily assume all risks associated with their stay and their use of The Resort’s facilities.

 

Indemnification

 

The guest agrees to indemnify, defend, and hold harmless The Resort from and against any and all claims, liabilities, damages, losses, expenses, and fees (including reasonable attorneys' fees) arising out of or in any way connected with the guest's or their visitors' or pets' use of The Resort’s property, facilities, or services. This includes, without limitation, any damage or loss to The Resort property, any injury or loss sustained by any person, and any violation of these policies or applicable laws by the guest, their visitors, or pets.

 

Property Damage

 

Guests will be held responsible for any and all damage to The Resort property caused by the guest, their visitors, or pets. This includes the cost of materials, labor for repairs, and any additional cleaning required to return the property to its original condition. Charges for such damages will be applied to the credit card on file used to book the stay.

 

Force Majeure

 

The Resort shall not be deemed in breach of this agreement or held liable for any cessation, interruption, or delay in the performance of its obligations hereunder due to causes beyond its reasonable control, including but not limited to: earthquake, flood, fire, storm, natural disaster, act of God, war, terrorism, armed conflict, labor strike, lockout, boycott, or pandemic.

 

Legal Compliance

 

Guests agree to comply with all applicable laws, regulations, and ordinances during their stay at The Resort. Any illegal activity will result in immediate expulsion from the property and may be reported to law enforcement authorities.

 

Entire Agreement

 

This Liability Protection Clause, as part of the Comprehensive Resort Policy and Procedures Statement, constitutes the entire agreement between the guest and The Resort regarding the subject matter hereof and supersedes all prior or contemporaneous agreements, understandings, promises, conditions, negotiations, warranties, and representations, whether written or oral, except as may be expressly provided herein.

 

Governing Law and Jurisdiction

 

This clause and the Comprehensive Resort Policy and Procedures Statement shall be governed by and construed in accordance with the laws of the state in which The Resort is located, without giving effect to any principles of conflicts of law. Any dispute arising under or in relation to this agreement shall be resolved exclusively in the state or federal courts located in said state, and guests expressly consent to the jurisdiction of such courts.

 

Acknowledgment

 

By booking a stay, utilizing the facilities, or entering the property of The Resort, guests acknowledge that they have read, understood, and agreed to the terms of this Liability Protection Clause and the Comprehensive Resort Policy and Procedures Statement in its entirety.

This Liability Protection Clause is designed to clearly communicate the responsibilities and acknowledgments of guests regarding their stay at the resort, ensuring that both parties are protected under the agreed terms.

 

Check-In and Check-Out Procedures

  • Check-In: Check-in time is between noon and 3 PM. Guests arriving outside these hours must notify the resort in advance. Failure to do so may result in waiting periods.

  • Check-Out: The designated check-out time is 10 AM. Guests wishing for a late check-out must request this 24 hours in advance. For excessively late check-out, a structured payment schedule will be negotiated.

  • Upon departure, guests should leave the key in the door of their cabin. This action signifies the completion of their stay. The cabins must be left in a condition closely resembling their initial state upon check-in. A cleaning fee of $60 will be levied for cabins left in an excessively dirty condition. Furthermore, any damages incurred during the stay will be charged to the guest, covering both materials and labor required to restore the cabin to its original state.

Pet Policy

  • Pets are welcomed at the resort with a daily fee of $25 per pet. This fee must be settled prior to the commencement of the stay.

  • A walkthrough of the cabin will be conducted upon arrival to note the cabin’s original condition. Post-stay, any damages or excessive cleaning required will incur a Repair Fee/Cleaning Fee, charged to the guest’s card on file.

  • Pets must be restrained at all times outside the cabins, either on leashes or in cages. Pets presenting a danger will result in their owners being asked to remove the pet from the resort or leave without a refund. The pool area and recreation room are off-limits to pets.

Guest Belongings

  • The resort assumes no responsibility for personal possessions left on the premises.

Quiet Hours

  • Quiet hours are enforced between 11 PM and 6 AM to ensure all guests enjoy a peaceful environment.

Pool Policy

  • Guests are required to behave safely and courteously in the pool area. No lifeguard is on duty, and guests use the pool at their own risk. Disruptive behavior may result in removal from the pool area. Glass items are strictly prohibited. Children under 10 must be accompanied by an adult.

Smoking and Vaping

  • Smoking and vaping are permitted outdoors but strictly forbidden inside cabins and the recreation room. Violators will incur a restoration fee of $300.

Cancellation Policy

  • Full refunds are provided for cancellations within 24 hours of booking, provided the check-in date is more than 30 days away. A 50% refund applies to cancellations made 60 days or more before check-in, a 20% refund for cancellations made between 60 to 7 days before check-in, and no refund for cancellations made less than 7 days before check-in. This policy includes protective clauses against payment denials by banks.

Bank Payment Obligations and Denials

  1. Financial Responsibility: The guest acknowledges and agrees that they are fully responsible for all charges incurred as a result of their booking and stay at The Resort, including, but not limited to, accommodation fees, pet fees, cleaning and repair charges, and any other fees or charges outlined in the Comprehensive Resort Policy and Procedures Statement.

  2. Credit/Debit Card Guarantee: At the time of booking, the guest shall provide a valid credit/debit card number as a guarantee for the reservation and any other applicable fees or charges. The guest hereby authorizes The Resort to charge the provided credit/debit card for all such fees and charges.

  3. Payment Denial: In the event that a bank or credit card issuer denies a charge for any fees or charges due under the terms of this agreement, including cancellation fees, the guest remains responsible for the payment of these charges. The Resort reserves the right to pursue all available legal remedies to collect any unpaid fees or charges.

  4. Notification of Denial: Should a payment be denied by the guest's bank or credit card issuer, The Resort will notify the guest of this denial promptly. The guest will be given a specific timeframe, not to exceed 7 days from the date of notification, to provide an alternative method of payment.

  5. Additional Charges for Payment Denial: In cases where payment is initially denied, and additional efforts are required to secure payment, The Resort may assess an administrative fee to cover the costs associated with these efforts. This fee will be in addition to any other fees or charges owed by the guest.

  6. Collection Costs: If The Resort incurs any costs, including legal fees, associated with the collection of unpaid fees or charges from the guest, the guest agrees to reimburse The Resort for all such costs in addition to the original amount owed.

  7. Acknowledgment of Financial Responsibility: By agreeing to the terms of the Comprehensive Resort Policy and Procedures Statement, the guest expressly acknowledges their financial responsibility for all charges as described herein and agrees not to contest such charges except in the case of billing errors, which must be reported to The Resort within [insert number] days of receiving the charge notification.

 

This Payment Denial Protection Clause is crafted to ensure that The Resort is protected against financial losses due to payment denials by banks or credit card issuers, providing a clear framework for handling such situations and ensuring that all parties understand their responsibilities and obligations regarding payments.

House Rules

  • Respectful behavior is required at all times. The resort reserves the right to remove excessively disruptive guests without a refund.

Guest Visitors

  • All visitors must be reported to resort staff. Visitors are not permitted to stay overnight. Guests are responsible for any damages or cleaning fees incurred by their visitors.

Wi-Fi and Television

  • The resort’s remote location in the Ozarks means Wi-Fi and television services are sporadic and not guaranteed. No refunds will be provided for service interruptions.

Guest Behavior

  • Disrespectful conduct will result in immediate removal without a refund. This policy is effective from the moment of booking.

Resort Property

  • Guests wishing to move resort property must seek staff approval. Damage or breakage will result in charges to the guest responsible.

Resort Staff Authority

  • Resort staff have full discretion over resort operations and guest management. Any matters not explicitly covered by this Policy are subject to the discretion of the resort staff.

Conclusion

This Policy is designed to ensure a harmonious and enjoyable experience for all guests while protecting The Resort’s interests. By agreeing to stay at the resort, guests are bound to adhere to these terms and conditions in their entirety.
